Privacy Policy

1. Who we are
Spotter is an internal software product created by Clair Concrete, Inc ("Clair Concrete," "we," "us"), a California corporation based in Bishop, California. Clair Concrete operates Spotter. "Spotter" is a product name and is not a separate company. Clair Concrete, Inc also does business as E&A Clair Construction.
Spotter is a safety training and compliance tool for construction companies. Clair Concrete is its first user. We are developing Spotter as a commercial service that other construction companies ("customer organizations") may use in the future.
2. Our role and the customer organization's role
Each customer organization decides which employees to add to Spotter and which trainings to assign. For employee records and training records, the customer organization is generally responsible for that information, and we process it on its behalf to provide Spotter. Clair Concrete is currently both the operator of Spotter and a customer organization using it for its own employees.
3. Information we collect
- Administrator and foreman accounts: email address, password (stored securely by our sign-in provider, never in plain text), and role.
- Employee records entered by an administrator, or submitted by employees themselves through the company's secure registration QR code or link: first and last name, mobile phone number, email address, preferred language (English or Spanish), notification preferences, crew assignment, and active or inactive status. Self-registrations are reviewed and approved by an administrator before they become employee records; the registration link never exposes existing employee information.
- Organization information: crew names and assigned foremen.
- Activity records: which trainings were published, sent, and reminded, including the date, the delivery method, and the result.
4. Safety training records and electronic acknowledgments
When an employee completes a toolbox talk, Spotter records:
- the employee's name and the training they completed,
- the date and time of acknowledgment,
- the language the training was viewed in,
- the method of acknowledgment (an electronic acknowledgment checkbox), and
- basic device information sent by the browser (the "user agent"), along with a unique record ID.
These records are used to produce training documentation for safety compliance, insurance, and legal purposes.
5. How we use information
- To send employees their assigned safety trainings and reminders.
- To let administrators and foremen track who has completed training.
- To create printable training records (PDFs) for OSHA inspections, insurance audits, and workers' compensation matters.
- To translate training content into Spanish and to format uploaded training documents, using an automated AI service. Training content is sent to that service. Employee contact details are not.
- To keep Spotter secure and working properly.
We do not use employee information for advertising.
6. SMS (text message) notifications
Program: Spotter Safety Notifications sends text messages about assigned safety toolbox talks, safety meeting assignments, reminders, and electronic acknowledgment requests. Each message includes a personal signing link.
How consent is collected: employees receive a private, expiring enrollment invitation from their employer by email or an onboarding QR code, not by SMS. No employee account is required. Employees enter the mobile number already recorded by their employer and actively select a separate, initially unchecked consent box. The form identifies Clair Concrete, Inc. as the sender of Spotter Safety Notifications and discloses variable message frequency, message and data rates, HELP/STOP instructions, and links to this policy and our Terms of Service. Enrollment cannot change the employer's phone record. Only employees consent; administrators cannot consent for them. Spotter records consent and withdrawal with the phone number, timestamp, method, and disclosure version. SMS delivery remains disabled until carrier registration is approved and the integration is configured.
Declining or withdrawing consent: SMS is optional. Employees who decline keep full access to Spotter and can receive trainings by email or from their foreman. You can withdraw consent through your private enrollment link or request a fresh invitation from your employer. Once messaging is active, reply STOP to unsubscribe. After a STOP request, we will not send further texts to that number unless you opt in again.
Messaging providers: our text messaging provider, Twilio, and mobile carriers process phone numbers and message content only to deliver the messages.
We do not sell or share SMS opt-in data, phone numbers, or personal information with third parties or affiliates for marketing or promotional purposes.
Who sends the texts: The registered sender for this program is Clair Concrete, Inc. Delivery is not active yet. The program is intended for its own employees. If Spotter later sends texts for other customer organizations, those messages will be identified with that organization and sent only under messaging registrations that cover them.
See also the Spotter SMS Notification Program terms.
7. Service providers
- Twilio: delivers text messages.
- Resend: delivers email notifications.
- Lovable and its cloud infrastructure partners: hosting, database, file storage, and sign-in.
- An AI language model service, accessed through Lovable: Spanish translation and formatting of training content.
Service providers may process information only to provide the services we request from them.
8. Storage, security, and access controls
Information is stored in a managed cloud database and encrypted in transit. Only signed-in administrators and foremen can view employee and training data, and foremen can see only their own crews. Employees do not have accounts. Each employee receives a unique, private signing link for each training, and anyone who has that link can open that one training.
No system is perfectly secure, and we cannot guarantee absolute security.
9. Customer organizations
Spotter currently holds data for one customer organization, Clair Concrete, Inc. Before other organizations use Spotter, we will put controls in place so that each organization can see only its own employees and records.
10. Data retention
We keep training records, acknowledgments, and related audit information for as long as the customer organization's Spotter subscription is active, and for 12 months after the subscription ends. After that period, the records are deleted. During the subscription, when an administrator removes a training or an employee who has completion history, Spotter archives the record instead of deleting it. Records with no history can be permanently deleted.
11. Your privacy rights, including California
You may ask to see, correct, or delete your personal information, subject to legal recordkeeping duties. If your information was provided by your employer, we may refer your request to that employer. California residents may have additional rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to know, delete, and correct information, and the right not to be discriminated against for using these rights. We do not sell or "share" personal information as those terms are defined under California law.
12. Children's privacy
Spotter is meant for adult workers and is not directed to children under 16. We do not knowingly collect information about children.
13. Where data is processed
Spotter is intended for use in the United States. Our service providers may process data in the United States or other countries where they operate.
14. Changes to this policy
We may update this policy. When we do, we will change the "Last updated" date at the top of this page.
