By using Spotter, including opening a training link, you agree to these Terms and to our Privacy Policy.

Spotter is an internal software product created and operated by Clair Concrete, Inc ("Clair Concrete," "we," "us"), a California corporation located at 438 Arboles Drive, Bishop, CA 93514. "Spotter" is a product name and is not a separate company. Clair Concrete, Inc also does business as E&A Clair Construction.

Spotter lets administrators publish weekly safety toolbox talks, distribute private training links and, when configured, send email notifications and approved SMS notifications, collect electronic acknowledgments, track completion, and export training records as PDFs. Spotter is designed for construction companies. Clair Concrete is its first user, and other customer organizations may use it in the future.

Each customer organization manages its own Spotter use. Only administrators and foremen have accounts, and administrators grant access. Workers do not have accounts. They use private, single-training links. Keep your login details confidential.

• Give accurate information.
• Acknowledge only trainings you have personally read or attended.
• Do not forward your personal signing link to anyone else.

Toolbox talks are general safety information. They do not replace site-specific training, supervision, or the safety requirements of your job. When you check the acknowledgment box and submit, you confirm that you reviewed the training.

You agree that your electronic acknowledgment is your signature. It has the same effect as a handwritten signature, as allowed by the federal E-SIGN Act and California's Uniform Electronic Transactions Act. Spotter records the time, language, and device information with each acknowledgment.

Administrators are responsible for the accuracy of employee records and training content, for keeping employee contact details current, and for meeting their own OSHA and other legal obligations. Spotter is a recordkeeping tool and does not guarantee legal compliance.

Do not misuse Spotter. This includes trying to access other people's data, interfering with the service, sending unauthorized messages, or uploading unlawful content.

Spotter does not currently charge users. If paid plans are offered to customer organizations, separate pricing terms will apply.

The Spotter software, name, and logo belong to Clair Concrete, Inc. Training content belongs to its authors or licensors.

Spotter relies on outside providers, including Twilio for texts, Resend for email, and cloud hosting. Those providers have their own terms, and we are not responsible for their outages.

We may change, pause, or discontinue Spotter features at any time. We do not promise uninterrupted availability.

Spotter is provided "as is." To the extent the law allows, Clair Concrete, Inc is not liable for indirect or consequential damages arising from use of Spotter. Nothing in these Terms limits rights employees have under workers' compensation or other employment laws.

We may suspend or end access for misuse or when someone's employment ends. Training records may be kept afterward as described in our Privacy Policy.

These Terms are governed by the laws of the State of California. If a dispute arises, both sides will first try to resolve it through good-faith negotiation. If that does not resolve it, the dispute will be decided in the appropriate state or federal courts located in California. These Terms do not require binding arbitration.

• Program name: Spotter Safety Notifications.
• What you'll receive: text messages about assigned safety toolbox talks, safety meeting assignments, reminders, and electronic acknowledgment requests, each with a personal signing link.
• Sender: Clair Concrete, Inc., operating Spotter Safety Notifications for its own employees. SMS delivery is not active yet. Messages for any other customer organization will be sent only under registrations that cover that organization.
• How to join: you receive an employer-provided private invitation by email or onboarding QR code, without an employee account. Enter the mobile number already recorded by your employer and check a separate, initially unchecked SMS consent box. Enrollment cannot change your employer’s phone record. Administrators cannot opt you in. Consent is not a condition of employment or of using Spotter.
• Participation is voluntary. Declining or opting out of texts does not end your access to Spotter. You can still receive trainings by email or from your foreman.
• Frequency: message frequency varies depending on assigned safety activities.
• Message and data rates may apply.
• STOP: withdraw consent through your private enrollment link, or request a fresh invitation from your employer. Once messaging is active, reply STOP to unsubscribe. After STOP, you will receive no further texts unless you opt in again.
• HELP: once messaging is active, reply HELP for assistance, or contact spotter@clairconcrete.net or (760) 458-9809.
• Mobile carriers are not liable for delayed or undelivered messages.
• We do not sell or share SMS opt-in data or phone numbers with third parties for marketing. See our Privacy Policy for how phone numbers are handled.

SMS consent enrollment is available through employer-provided private invitations. Submission displays an in-app confirmation and records consent with a timestamp and disclosure version. SMS delivery remains disabled until carrier registration is approved and the integration is configured.
